Terms of
Service.
These terms govern use of this website and the general conditions under which GWT HAULING LLC provides freight services. Individual shipments are governed by the bill of lading and written contract.
1. Acceptance
By using this website you accept these Terms of Service and our Privacy Policy. If you do not agree, do not use the site. These terms govern website use; shipments are governed by the bill of lading, rate confirmation, and any written contract of carriage.
2. Services
GWT Hauling LLC provides motor carriage of general freight: local trucking, long-distance truckload (TL), long-distance less-than-truckload (LTL), container trucking, and contract bulk mail transportation. Service is provided subject to equipment availability, lawful lanes, and acceptance of the load.
3. Quotes and Rates
Quotes issued by phone, email, or form are estimates until confirmed by a written rate confirmation. Accessorial charges — detention, liftgate, lumper, re-delivery, storage — apply per the confirmation or standard schedule. The confirmed rate governs the invoice.
4. Shipper Responsibilities
- Tender freight properly packaged, marked, labeled, and safe for transport.
- Provide accurate weight, dimensions, commodity description, and piece count.
- Ensure loading and unloading facilities are accessible and safe.
- Tender hazardous or regulated materials only under applicable law and with advance written notice — we do not accept undeclared hazardous freight.
- Load and count LTL freight where driver-count is not specified.
5. Bills of Lading
Every shipment moves under a bill of lading. The shipper's and consignee's representations on the BOL are relied upon. Discrepancies noted at pickup or delivery must be recorded on the delivery receipt at the time.
6. Prohibited and Restricted Freight
- No undeclared hazardous materials, explosives, or illegal goods.
- High-value or extraordinary-value shipments must be declared in advance in writing.
- Bulk mail moves only under contract with appropriate documentation.
- We may refuse any load that is unsafe, unlawful, misdescribed, or beyond equipment capacity.
7. Cargo Liability and Claims
Carrier liability for loss or damage is limited by the bill of lading, applicable law, and the terms of the contract of carriage — commonly capped per pound or per shipment unless excess value is declared in advance and additional charges paid.
Claims procedure
- Visible damage or shortage must be noted on the delivery receipt at delivery.
- Written claims must be filed within nine (9) months of delivery or expected delivery date.
- Salvage and mitigation duties apply; claimants must preserve packaging and goods for inspection.
8. Delays
Transit times are estimates, not guarantees. We are not liable for delay caused by weather, road conditions, mechanical failure, government action, or circumstances beyond our control; we will communicate revised ETAs promptly per our service rules.
9. Payment
Invoices are payable per the terms on the invoice — typically net 15 or net 30. Unpaid balances may accrue late charges; disputed amounts must be raised in writing within thirty days of invoice date.
10. Confidentiality
Business terms, lane rates, and shipment information exchanged between the parties are confidential and used only to perform the work, subject to the Privacy Policy and law.
11. Website Use
- Use the site lawfully; do not probe, disrupt, or extract its systems or data at scale.
- The contact form is for genuine rate requests — no spam, scraping, or automated submission.
- Do not misrepresent identity, freight contents, or authority to ship.
12. Intellectual Property
Site content — text, design, graphics, the mile-marker identity — is the property of GWT Hauling LLC and may not be reproduced without permission.
13. Disclaimers
This site is provided "as is." We disclaim warranties of accuracy, completeness, and fitness for a particular purpose to the maximum extent permitted by law. Descriptions of service are general; the bill of lading and contract govern actual carriage.
14. Limitation of Liability and Indemnification
To the maximum extent permitted by law, GWT Hauling LLC is not liable for indirect, incidental, or consequential damages arising from site use, and cargo liability is limited as stated in Section 7. You agree to indemnify GWT against claims arising from misdescribed, improperly packaged, or unlawfully tendered freight.
15. Governing Law and Changes
These terms are governed by the laws of the State of Ohio; venue lies in the courts of Williams County, Ohio, unless a contract provides otherwise. We may update these terms; the current version is on this page. Contact: m.almeida@gwthauli.shop · +1 (979) 697-2739 · 15877 County Road O, Pioneer, OH 43554, United States.
